Legal

Privacy policy.

How we collect, use and protect your personal information, in line with POPIA. Last updated 7 October 2026.

01. Who we are

Seamount Design (“we”, “us”) is a small design studio in South Africa offering branding, websites, marketing and hosting. We are the responsible party for the personal information described in this policy, and we process it in line with the Protection of Personal Information Act, 2013 (POPIA).

Our Information Officer is Bjorn van der Linde. You can reach him at bjorn@seamountdesign.com or +27 67 617 2127.

02. What we collect

We only collect what we need to talk to you and do the work:

When you use our contact form: your name, email address, business name (optional), the services you are interested in and your message.

When you email or call us: the details you choose to share.

When you become a client: billing and contact details, the content and files you give us for your project, and any logins you share so we can build or look after your website.

When you visit this website: our hosting provider keeps standard server logs (such as IP address, browser type and the pages requested) for security and to keep the site running.

If you accept analytics cookies: Google Analytics records how you use this website, such as the pages you view, how you found us, your general location (city or country), and your device and browser. It does not tell us who you are. We do not use advertising or profiling cookies.

03. How we use it

To reply to your enquiry and prepare a quote.

To plan, deliver and support your project, including hosting and maintenance.

To send invoices and keep the records the law requires.

To keep this website secure and working properly.

We will not send you marketing emails unless you ask for them, and you can opt out at any time.

04. Why we may use it

We process your information because you have given it to us for a reason (for example, to get a quote), because we need it to carry out a contract with you, to meet our legal obligations, or for our legitimate interests in running and protecting the business. You can withdraw your consent at any time.

05. Who we share it with

We never sell your personal information. We only share it with trusted service providers who help us run the business, and only as much as they need:

Website hosting: this website and its email are hosted in South Africa.

Email and file storage providers we use to communicate and to store project files.

Google: our fonts load from Google’s servers, so your browser shares your IP address with Google when you visit. If you accept analytics cookies, Google Analytics also processes your visit data for us. Google may store this data outside South Africa.

Accounting and payment providers, for clients only.

Some of these providers may store information outside South Africa. When that happens, we only use providers that are bound by laws or agreements giving protection similar to POPIA. We may also disclose information if the law requires it.

06. How long we keep it

Enquiries that do not lead to a project: up to 12 months, then deleted.

Client records: for as long as we work together, and afterwards for as long as tax and accounting laws require (usually five years).

When we no longer need your information, we delete or anonymise it.

07. How we protect it

We use reasonable technical and organisational measures to keep your information safe, including encrypted connections (SSL), access limited to the people doing the work, up-to-date software and regular backups. No system is completely secure, but if a breach ever affects your information, we will let you and the Information Regulator know as POPIA requires.

08. Cookies

This website uses cookies that are needed for it to work, such as those set when we log in to manage the site. With your consent, we also use Google Analytics cookies (named _ga) to count visits and see which pages are useful. They are only set after you click Accept in our cookie banner, and they expire after 13 months. If you click Reject, no analytics cookies are set. Your choice is stored in your browser (in local storage, not a cookie) for 12 months. You can change your mind at any time with the Cookie settings link at the bottom of every page.

09. Your rights

Under POPIA you can:

Ask whether we hold personal information about you and request a copy.

Ask us to correct or update your information.

Ask us to delete your information, or object to us using it.

Withdraw your consent at any time.

Complain to the Information Regulator.

To use any of these rights, email bjorn@seamountdesign.com. We may need to confirm your identity first, and we will reply within a reasonable time. If you are not happy with how we handled your information, you can contact the Information Regulator at inforegulator.org.za.

10. Children

Our services are for businesses and are not aimed at children under 18. We do not knowingly collect information from children.

11. Changes to this policy

We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated at the top.

Questions about this policy? Email bjorn@seamountdesign.com and we will gladly help.
